Workers Watchdog to Tackle Modern Slavery

The government plans to launch a new workers’ watchdog to take over protecting the rights of UK workers.

The new body will be responsible for tackling modern slavery, enforcing the minimum wage and protecting agency workers.

Currently these tasks are spread across three different bodies.

It said it was looking at extra curbs targeting the garment sector including banning sales if brands’ behaviour does not improve.

The government is looking at these specific measures after reports of serious problems in the industry, the Department for Business, Energy and Industrial Strategy said.

The Austrian based organisation NOYB – European Center for Digital Rights has commenced its campaign to rid web sites of unlawful cookie banners.

The GDPR and PECR were meant to give users full control over their data and ensure that company/organisational marketing was only received by those who actually request it.

The NOYB current focus is on web sites that make it difficult to reject non-essential cookies, but Concrew Training also notes that many web sites don’t even give you the choice to opt out.

In short these companies and organisations are likely to be in breach of the GDPR and PECR and risk fines of up to 4% of global turnover or Euro 20 Million.

With the NOYB moving to report some 10,000 companies a year no business or organisation can afford for their sales and marketing teams to ignore the GDPR and PECR.

Undesirable Guest Lists are a NO NO

The operation of an “undesirable guest list” has led to Pontins, the well-known family holiday park company, to be investigated by the Equality and Human Rights Commission for breaches of the Equality Act 2010.

Pontins have agreed to:

  • Conduct an investigation into its ‘Undesirable guest’ list to ensure appropriate action is taken within the organisation and that lessons are learned;
  • Commission a review of its current intelligence system, booking policies and commercial vehicle policy to ensure they are not operating in a discriminatory way, and consider any recommendations;
  • Provide enhanced training on equality law for staff in its Human Resources team and members of Senior Management;
  • Provide training on equality and diversity for all customer facing staff on an annual basis;
  • Appoint Equality, Diversity and Inclusion champions across the organisation.

This case is a good example of how management and staff can, in good faith introduce policies and procedures that they believe are beneficial to their company that actually expose their employer to great risk.

Equality problems remain common place, this case illustrates that equality issues are more widespread and prevalent than the headline making #BLM and #MeToo.

Modern slavery remains rife in the UK, car washes, nail bars, crop picking, and manufacturing are just a few of the more frequent areas modern slavery is found. The truth is it can be found almost anywhere, indeed back in 2017 a man was jailed for keeping his wife in slavery. We all need to take more action NOW!

Many businesses view price as a key determinant when purchasing products and services but those that deliver the lowest prices may be more reliant on slave labour. UK businesses have a duty to remove slavery from their supply chains.

So much so that businesses now need to register policy statements with the Government

Having strict anti-slavery policies, coupled with supply chain audits and increased management/staff awareness are effective ways to combat modern slavery.

UK Immigration rules

Following the UK’s exit from the EU the rules relating to foreign nationals working and living in the UK were revised. It is important that UK businesses understand these rules and follow them, closely when employing foreign nationals

Entry requirements revolve round

  1. UK Points Based Immigration System
  2. UK Shortage Occupations
  3. The concept of “Tradeable” characteristics
  4. Other/specialist routes to work and study in the UK.

Points System
To be eligible to work in the UK an applicant must secure 70 points. These are totted up from a selection of eight characteristics. The first three characteristics are mandatory and the applicant must meet these full. The other five characteristics are termed “tradeable”. A sort of “pick and mix” approach for applications based on these “tradeable” considerations but with the proviso that the first three characteristics are fully met.

Shortage Occupations
Every job has a Standard Occupational Classification code, and each code has a designated skill level. The code determines whether the job is eligible for the Skilled Worker Visa route.
