As at May 2026 some of the most significant changes are being driven by the Employment Rights Act 2025 and newly launched Fair Work Agency; both of which place far greater emphasis on employers adopting robust compliance and breach investigation processes.
The Worker Protection Act (Preventative Duty on Sexual Harassment) has been further amended with employer liabilities for third parties such as customers and other stakeholders, with a pending change requiring employers to take all reasonable action to prevent the sexual harassment of their employees; as above the emphasis is on employers taking comprehensive proactive action and evidencing that they have do so.
New Data Protection regulations have brought in a demand for visible complaints procedures as well as fresh provisions looking at legitimate interests, subject access requests and the processing of sensitive staff data. There is more to come.
