The Worker Protection Act places employers under a specific duty to prevent sexual harassment at work. In the event of any abuse taking place, employers will need to demonstrate that they have taken reasonable steps to comply with the legislation. In simple terms this means they need to be able to evidence compliance with all aspects of the EHRC code of practice for preventing sexual harassment at work.
This will require:
- Existing policies and procedures be assessed for effectiveness,
- Policies and procedures to be updated
- All staff to be trained in said policies and procedures
- Staff training evidenced
- Management to be trained in how to respond to and investigate concerns
All this has to be in place before October 2024 at the very latest.
