As of 01 December 2025 the early conciliation period is increasing from 6 weeks to 12 weeks.

In October 2026 the Employment Rights Bill is expected to increase the time period for bringing an employment tribunal claim from 3 months to 6 months.

When an employee notifies ACAS that they wish to escalate their grievance to claim via an employment tribunal ACAS offers an early conciliation process.  That is to say that look at the evidence provided by both the employee and the employer and try to facilitate a legally binding agreement between the two parties and avoid the formal tribunal process.

As of 01 December 2025 this conciliation period is increasing from 6 weeks to 12 weeks.  The aim being to reduce time pressures on ACAS.

In October 2026 the Employment Rights Bill is expected to increase the time period for bringing an employment tribunal claim from 3 months to 6 months.

This means that when an employee appeals a grievance outcome and this appeal is not upheld the employer then faces a period of 9-12 months before they know if it will go to tribunal.  An unsettling period and one that all management should be aware of.
